In Québec, municipalities are prohibited from splitting a contract into multiple smaller contracts in order to circumvent the public policy rules that require competitive tendering. In this module, we discuss this prohibition and its exceptions, such as situations when splitting a contract is warranted on the grounds of sound administration.
*Note: Since this video was recorded, certain changes should be taken into account:
– Instead of section 938.0.3 of the Municipal Code and its equivalent in the Cities and Towns Act, this now refers to section 19 of the Act respecting contracting by municipal bodies (ACMB).
– Near the end of the video, it is mentioned that the ACMB will come into force in spring 2026, on a date to be determined by the government. That date is April 1, 2026.
